Hayseed is a flashcards app. Hayseed is not a platform to express your views, not a file storage site, not social media. Hayseed is a platform to (1) memorize lists of facts by rote, and (2) to share lists of facts so that others may memorize them by rote. Any use of hayseed inconsistent with these two purposes is forbidden.
You have permission to use this service for those two purposes until (a) you violate the conditions and policies herein or (b) we revoke your permission to use this service. We may revoke permission for any reason or no reason, because this is a free service. We don't even get ad money out of this.
This document is not a contract, it is a license (permission). You are granted a license to use hayseed under the terms and conditions set forth herein. If you use hayseed in a way that is inconsistent with this license, then you are exceeding your authorized use of hayseed.
Defined categories of content:
Illegal Content
Content that is a crime, tort, or civil offense to publish in the United States, Switzerland, or The Netherlands:
- Materials that infringe on copyrights or trade secrets.
- Libelous material, including trade libel.
- Child pornography and child abuse materials.
- Scams or schemes to defraud.
- Revenge porn.
- Threats.
- All other content that is a crime, tort, or civil offense to publish in the United States, Switzerland, or the Netherlands.
Patently Offensive Content
Content that is not necessarily illegal, but categorically serves no legitimate purpose here and poses a significant risk of reputational harm:
- Pornography.
- Gore.
- Animal abuse images, video, or audio.
- Shock images, video, or audio.
- Content that appears to be intended to target an individual or group for harassment.
Spam
Content that categorically serves no legitimate purpose here and makes hayseed difficult to use for others:
- Advertisements for or against any business, service, or product.
- Advertisements for or against any political party, candidate, or cause.
Other Banned Content
Potentially legitimate content that we still do not allow because it raises legal compliance issues that we don't want to deal with:
- Nudity of the genital or anal region or female breasts.
No-Publish Content
Legitimate content that poses a high risk of reputational harm to hayseed:
- Slurs and bigoted content, where there is a clear educational purpose.
Shitpost Content
Content, the legitimacy of which, requires a determination of the accuracy and quality of content:
- False or inaccurate content.
- Redundant content.
- Slurs and bigoted content with no clear educational purpose.
- Prolific content of low quality.
Hayseed has sole discretion to determine whether content falls into any of the above categories.
Absolutely Forbidden Acts:
- Uploading, sharing, or publishing Illegal Content, Patently Offensive Content, Spam, or Other Banned Content.
- Hacking, doxxing, accessing any user account or part of the server or interface without authorization.
Moderation guidelines:
- Uploading or sharing Illegal Content, Patently Offensive Content, Spam, or Other Banned Content will result in the uploading or sharing user being banned on the first offense. Such users will permanently lose all access to all of their uploaded files, which we may preserve as evidence or destroy as permitted or required by applicable law.
- Uploading No-Publish Content is generally allowed, but it may be shared only user-to-user. If you designate No-Publish Content public, then we may warn you, remove your sharing or publication privileges, or ban you completely.
- Uploading Shitpost Content is generally allowed, but it may be shared only user-to-user. If you designate Shitpost Content public, then we may warn you, remove your sharing or publication privileges, or ban you completely.
- If you engage in any activity that threatens Hayseed's ability to function efficiently, threatens Hayseed's reputation, or is generally intended to annoy, vex, or harass other users, you may be warned, your sharing privileges may be removed, or you may be banned completely.
- If you engage in any malicious conduct, you may be warned, your sharing privileges may be removed, or you may be banned completely.
These are only guidelines. We have sole discretion whether to allow you to use hayseed in the first place, because this is a free service. We can actually ban you for no reason at all. These guidelines are only intended to give you fair warning of how we intend to moderate.
In the case of a situation where we think you should be banned and you disagree, your only recourse is to have already backed up your stuff, because we're going to ban you and delete your content from our servers.
Privacy:
We do not collect any data about you, except what is needed to run this site. The information we collect includes your e-mail address, your uploaded files, and certain metadata ("Collected Information"). The metadata we collect includes uploaded file sizes, screen resolutions, bandwidth usage, storage usage, dates and times that you use hayseed, and other information that is reasonably necessary to make hayseed work and work well. We don't collect your name, location, date of birth, or other personally identifying information (unless you go out of your way to give it to us, like by saving it as your display name). That is the extent of Collected Information. We do not sell Collected Information to anyone for any purpose.
Your Collected Information may be visible to others using Hayseed. We do not display your e-mail address to regular users as a matter of course, but it may be visible to moderators and administrators. While we do not sell Collected Information to anyone for any reason, we may disclose it for free to third parties as reasonably necessary to make Hayseed work and work well. For example, we may contract with an outside software development firm, and that firm may be able to see your Collected Information. We will never intentionally disclose your Collected Information to a third party, even for free, if we believe the third party will use your Collected Information for marketing purposes. We will disclose your Collected Information in response to a subpoena or other court order, as otherwise required by law, or as reasonably required to protect Hayseed's interests (such as in order to present a defense in litigation).
We will only e-mail you (1) as required by law, (2) to reset your password, (3) to alert you of revocation of privileges, (4) or to alert you of major security vulnerabilities, policy changes, or functionality changes.
hayseed respects intellectual property rights and responds to valid notices of copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
To submit a takedown notice, provide the following in writing to the designated agent:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material to be removed, with sufficient detail to locate it.
- Your contact information (name, address, phone, email).
- A statement of good faith belief that the use is not authorized.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Counter-notices. If you believe your content was removed in error, you may submit a counter-notice with the information required under 17 U.S.C. § 512(g)(3).
Repeat infringers will have their accounts terminated.
